Amend the bill in section 2 in §15688 by striking out subsection 3-B (page 2, lines 37 to 40 and page 3, lines 1 to 11 in L.D.) and inserting the following:
‘ 3-B. Member municipalities in school administrative districts or community school districts; contribution. Beginning July 1, 2008, for each municipality that is a member of a school administrative district or community school district, the commissioner shall annually determine each municipality's contribution to the total cost of education in accordance with this subsection. A municipality's contribution to the total cost of education must be determined by a cost-sharing formula established by the department by rule. The formula must assign each municipality its share of the unit's contribution to the total cost of education determined under subsection 3-A, paragraph C. The cost-sharing formula must establish the contribution levels in a manner that ensures that no less than 50% of the unit's contribution to the total cost of education is shared primarily on the basis of the comparative wealth of each municipality calculated at least in part using the property fiscal capacity of each municipality. Rules adopted under this subsection are routine technical rules as defined in Title 5, chapter 375, subchapter 2-A.’
summary
This amendment is the minority report of the Joint Standing Committee on Education and Cultural Affairs. The amendment strikes the provision of the bill that requires the inclusion of the relative pupil counts of each member municipality in the Department of Education rules that establish the cost-sharing formula that determines each municipality’s contribution to the total cost of education of the school district. The amendment also strikes the provision that permits the inclusion of other factors in the rules that the department determines to be relevant and appropriate to the cost-sharing formula. Finally, the amendment changes the implementation date for the initiatives proposed in the bill from July 1, 2009 to July 1, 2008.
