An Act To Exempt Maintenance Workers from Licensure for General Electrical Maintenance
Be it enacted by the People of the State of Maine as follows:
Sec. 1. 32 MRSA §1101, sub-§5-A is enacted to read:
5-A. Maintenance worker. “Maintenance worker” means a person who is engaged in the business of doing regular repair or restoration of machines, mechanical equipment, buildings, plumbing or electrical, air conditioning or heating systems.
Sec. 2. 32 MRSA §1102-A, sub-§10, as amended by PL 2003, c. 551, §1, is further amended to read:
10. Pump installers. A person licensed under chapter 69-C, except that this exception applies only to disconnection and connection of electrical conductors required in the replacement of water pumps of the same or smaller size in residential properties and the installation of new water pumps and associated equipment of 3 horsepower or smaller; or
Sec. 3. 32 MRSA §1102-A, sub-§11, as enacted by PL 2003, c. 551, §2, is amended to read:
11. Wastewater treatment plants. Wastewater treatment plants, as defined in section 4171, and regular employees of wastewater treatment plants making electrical installations in or about wastewater treatment plants . ; or
Sec. 4. 32 MRSA §1102-A, sub-§12 is enacted to read:
12. Maintenance worker. A person employed as a maintenance worker as part of the regular maintenance staff of a corporation, as defined by Title 13-C, section 102, subsection 4, or nonprofit corporation, as defined by Title 13-B, section 102, subsection 9, who is not otherwise licensed under this chapter, except that this exception applies only to the repair or replacement of light fixtures, light switches, lighting ballasts and electrical outlets not exceeding 120 volts in any building or on property that is owned or operated by the corporation.

This bill exempts a maintenance worker employed by a corporation from licensing requirements when engaged in the repair or replacement of light fixtures, light switches, lighting ballasts and electrical outlets not exceeding 120 volts in any building or on property that is owned or operated by the corporation, provided the maintenance worker is a member of the corporation’s regular maintenance staff.
