Resolve, To Increase the Authority of the Consumer Protection Division of the Office of the Attorney General

Sec. 1. Enforcing mediated decisions. Resolved: That the Attorney General shall adopt rules to assist any person who files a complaint with that office concerning any loss of money or property, real or personal, as a result of the use or employment by another person of a method, act or practice declared unlawful by the Maine Revised Statutes, Title 5, section 207 or by any rule issued under Title 5, section 207. The rules must require that, if either of the parties does not abide by any solution reached in a mediation program administered by the Attorney General, the Attorney General shall bring an action either in the Superior Court or the District Court for the aggrieved party. Rules adopted pursuant to this section are routine technical rules as defined in Title 5, chapter 375, subchapter 2-A.

This resolve requires the Attorney General to adopt rules to assist consumers in achieving resolution in disputes with businesses when the consumer and the business have reached a solution in mediation and one party changes its position afterwards.
