An Act To Further Protect Water Quality in Coastal Waters
Be it enacted by the People of the State of Maine as follows:
Sec. 1. 38 MRSA §423-E is enacted to read:
§ 423-E. Feeding of waterfowl in intertidal zone; prohibition
1. Definitions. As used in this section, unless the context otherwise indicates, the following terms have the following meanings.
A. "Intertidal zone" means all land affected by the tides between the mean high-water mark and the mean low-water mark.
B. "Migratory bird" has the same meaning as "migratory game bird" in Title 12, section 10001, subsection 39.
2. Prohibition. A person may not intentionally feed any migratory bird or seagull on public property in the intertidal zone.
Sec. 2. 38 MRSA §423-F is enacted to read:
§ 423-F. Removal of animal waste in intertidal zone
A person shall remove fecal matter deposited by that person's animal on public property in the intertidal zone as defined in section 423-E, paragraph A.

This bill prohibits the feeding of migratory waterfowl and seagulls on public property in the intertidal zone. The bill also requires the removal of fecal matter of pets on public property in the intertidal zone.
