An Act To Protect Veterinarians Providing Animal Welfare Services for the State
Be it enacted by the People of the State of Maine as follows:
Sec. 1. 7 MRSA §3909-A is enacted to read:
§ 3909-A. Immunity from civil liability
1. Immunity. A licensed veterinarian who performs any animal welfare service at the request of the State or a state agency is immune from any civil liability arising from that service if:
A. The service is within the scope of that veterinarian's licensure; and
B. The veterinarian acts in good faith.
2. Exception. The immunity provided by this section is not available if the veterinarian acted recklessly or with gross negligence.
