‘Preamble. Whereas, the Workers' Compensation Board issued a decision in the case of Joseph Greenier, Case #89021459E; and
Whereas, there is reason to believe that Joseph Greenier did not comprehend the complexities of the administrative procedures; and
Whereas, Joseph Greenier was not afforded an advocate in the case; and
Whereas, information relevant to the case was allegedly lost or misplaced and process notification may not have been received; and
Whereas, there may be a genuine dispute as to the facts of the case; and
Whereas, because of the special circumstances of this case, a review is necessary and appropriate; now, therefore, be it:
Sec. 1. Review workers’ compensation case. Resolved: That, notwithstanding any provision of law to the contrary, the Workers' Compensation Board shall hold a hearing to review the case of Joseph Greenier, Workers' Compensation Board case #89021459E. After reviewing the case, the board shall report its findings and recommendations to the joint standing committee of the Legislature having jurisdiction over labor matters by January 15, 2009. The joint standing committee may submit legislation relating to the report to the First Regular Session of the 124th Legislature.’
