An Act To Prohibit Credit Checks for Purposes of Employment
Be it enacted by the People of the State of Maine as follows:
Sec. 1. 5 MRSA §7051, sub-§8 is enacted to read:
8. Credit check prohibited. The director or director’s agent may not perform or require a credit check on an employee or a prospective employee as a condition of hiring, appointment or employment.
Sec. 2. 26 MRSA §597, as enacted by PL 1991, c. 366, is amended by adding at the end a new paragraph to read:
An employer or agent of an employer may not perform or require a credit check on an employee or a prospective employee as a condition of hiring or employment.
