An Act To Limit the Duration of a Legal Alien's Driver's License
Be it enacted by the People of the State of Maine as follows:
Sec. 1. 29-A MRSA §1301, sub-§3-A is enacted to read:
3-A. Proof of citizenship. An applicant for a license or nondriver identification card must provide proof of citizenship or documentation of legal residency inside the United States.
Sec. 2. 29-A MRSA §1406, sub-§1, as repealed and replaced by PL 2003, c. 434, §22 and affected by §37, is amended to read:
1. Expiration of license; persons under 65 years of age. The Except as provided in subsection 2-A, the following provisions apply to the expiration of a license for persons under 65 years of age.A. A noncommercial license to operate a motor vehicle issued to a person under 65 years of age expires at midnight on the license holder's 6th birthday following the date of issuance.
B. A commercial driver's license to operate a motor vehicle issued to a person under 65 years of age expires at midnight on the license holder's 5th birthday following the date of issuance.
Sec. 3. 29-A MRSA §1406, sub-§2, as repealed and replaced by PL 2003, c. 434, §22 and affected by §37, is amended to read:
2. Expiration of license; persons 65 years of age and over. A Except as provided in subsection 2-A, a license to operate a motor vehicle issued to a person 65 years of age or older at the date of issuance expires at midnight on the license holder's 4th birthday following the date of issuance.
Sec. 4. 29-A MRSA §1406, sub-§2-A is enacted to read:
2-A. Expiration of license; legal aliens. A license to operate a motor vehicle issued to a person residing in this country under a visa granted by the authority of the United States who is not a citizen of the United States expires in accordance with subsection 1 or 2 or upon expiration of the visa, whichever comes first.
Sec. 5. 29-A MRSA §1410, sub-§4, as enacted by PL 1997, c. 437, §40, is amended to read:
4. Expiration. Each nondriver identification card issued pursuant to this section expires 6 years from the date of issuance , except that a nondriver identification card issued to a person residing in this country under a visa granted by the authority of the United States who is not a citizen of the United States expires 6 years from the date of issuance or upon expiration of the visa, whichever comes first.
