| | 6.__Filing of certified final order with court; effect of | filing.__If a petition for judicial review of a final order is | not filed in accordance with section 16609, the administrator may | file a certified copy of the final order with the clerk of a | court of competent jurisdiction. The order so filed has the same | effect as a judgment of the court and may be recorded, enforced | or satisfied in the same manner as a judgment of the court. |

| | 7.__Enforcement by court; further civil fine.__If a person | does not comply with an order under this section, the | administrator may request that the Attorney General petition a | court of competent jurisdiction to enforce the order. The court | may not require the administrator to post a bond in an action or | proceeding under this section. If the court finds, after service | and opportunity for hearing, that the person was not in | compliance with the order, the court may adjudge the person in | contempt of the order. The court may impose a further civil fine | against the person for contempt in an amount not to exceed | $10,000 per violation and may grant any other relief the court | determines is just and proper in the circumstances. |

| | 8.__Appointment of presiding officer.__For purposes of any | hearing conducted pursuant to this section, the administrator may | appoint a qualified person to preside at the hearing and to make | proposed findings of fact and conclusions of law. The | responsibility for the entry of the final findings of fact and | conclusions of law and for the issuance of any final order remain | with the administrator. |

| | 1.__Issuance and adoption of forms, orders and rules.__In | addition to specific authority granted elsewhere in this chapter, | the administrator may: |
|
| A.__Issue forms and orders and, after notice and comment, | adopt and amend rules necessary or appropriate to carry out | this chapter and may repeal rules, including rules and forms | governing registration statements, applications, notice | filings, reports and other records; |
|
| B.__By rule, define terms, whether or not used in this | chapter, but those definitions may not be inconsistent with | this chapter; and |
|
| C.__By rule, classify securities, persons and transactions | and adopt different requirements for different classes. |
