| An Act To Prevent the Introduction of Pathogens into the |

| State That Threaten the Health of Maine's Fish and Wildlife |

| | Emergency preamble. Whereas, acts of the Legislature do not become | effective until 90 days after adjournment unless enacted as | emergencies; and |
|
| | Whereas, chronic wasting disease is a fatal, highly infectious | disease that has devastated deer and moose populations in other | states; and |
|
| | Whereas, chronic wasting disease is an immediate threat to | Maine's deer and moose population; and |
|
| | Whereas, immediate action is necessary to prevent the spread of | this disease into Maine's deer and moose population; and |
|
| | Whereas, in the judgment of the Legislature, these facts create | an emergency within the meaning of the Constitution of Maine and | require the following legislation as immediately necessary for | the preservation of the public peace, health and safety; now, | therefore, |

| Be it enacted by the People of the State of Maine as follows: |

| | Sec. 1. 12 MRSA §10105, sub-§13 is enacted to read: |

| | 13.__Prevention of introduction of harmful pathogens into | Maine's fish and wildlife population.__To prevent the | introduction of pathogens into the State that pose a significant | risk to the health of Maine's unique fish and wildlife | populations, the commissioner may prohibit or otherwise regulate | the transportation of a fish or wildlife species or any part of a |
