| Be it enacted by the People of the State of Maine as follows: |

| | Sec. 1. 7 MRSA c. 415 is enacted to read: |
|
| MAINE PESTICIDE EDUCATION FUND |
|
| | The Maine Pesticide Education Fund, referred to in this | chapter as "the fund," is established.__The fund consists of | revenues received pursuant to Title 8, section 387 and any funds | received as contributions from private and public sources.__The | fund, to be accounted within the department, must be held | separate and apart from all other money, funds and accounts.__ | Eligible investment earnings credited to the assets of the fund | become part of the assets of the fund.__Any balance remaining in | the fund at the end of any fiscal year must be carried forward to | the next fiscal year. |

| §2422.__Expenditures from fund; distribution |
|
| | Funds in the Maine Pesticide Education Fund must be | distributed as follows: |
|
| | 1.__Integrated Pest Management Fund.__Three percent of the | money in the fund to the Integrated Pest Management Fund | established under section 2405; |
|
| | 2.__Pesticide education and pesticide pick-up programs.__ | Fifty-two percent of the money in the fund to the Board of | Pesticides Control for pesticide education programs and pesticide | pick-up programs; and |
|
| | 3.__Pest management education.__Forty-five percent of the | money in the fund to the University of Maine Cooperative | Extension for pest management education programs, including, but | not limited to, homeowner integrated pest management, structural | and school pest management and medical and veterinary pest | management. |

| | Sec. 2. 8 MRSA §374, sub-§6 is enacted to read: |

| | 6.__Pesticide education lottery game.__No later than January | 30, 2006, the commission, in consultation with the Integrated | Pest Management Council and the Board of Pesticides Control, | shall develop and initiate a pesticide education lottery game | designed to raise funds for the Maine Pesticide Education Fund | established pursuant to Title 7, chapter 415.__The commission |
