| Be it enacted by the People of the State of Maine as follows: |

| | Sec. 1. 8 MRSA §1037 is enacted to read: |
|
| §1037.__Parking lot monitoring |
|
| | A slot machine operator must monitor, on an hourly basis | during operating hours, any parking facility serving the licensed | premises to ensure that no child under 16 years of age has been | left unattended in any vehicle parked in such facility.__ | Monitoring under this section means visual inspection of the | premises by persons employed by the slot machine operator. |
|
| | Sec. 2. 8 MRSA §1054, sub-§§8 and 9, as enacted by PL 2003, c. 687, Pt. | A, §5 and affected by Pt. B, §11, are amended to read: |
|
| | 8. Failure to deposit funds. Violates section 1036, | subsection 2; or |
|
| | 9. Failure to grant access to premises, equipment and | records. Violates section 1042.; and |
|
| | Sec. 3. 8 MRSA §1054, sub-§10 is enacted to read: |
|
| | 10.__Child endangerment.__Violates section 1037, and a child | under 16 years of age has been left unattended for more than 2 | hours in a parked vehicle on the premises of the slot machine | operator. |
|
| | This bill seeks to prevent the endangerment of children by | requiring slot machine operators to conduct regular visual | monitoring of their parking lots to ensure that children under 16 | years of age have not been left unattended and establishes | criminal penalties for failure to provide such monitoring. |
