Be it enacted by the People of the State of Maine as follows:

 
Sec. 1. P&SL 1981, c. 22, §3, first ¶, as amended by PL 1981, c. 470, Pt.
B, §15, is further amended to read:

 
*Sec. 3. Election of directors. The elected directors shall must be
elected by a plurality vote of the legal voters resident on the
islands composing the district at an election to be held at the
time of the municipal elections for the City of Portland, with
the first election to be held Monday, May 4, 1981. Beginning
with the election held in 2006, a director who is required to be
a resident of or property owner on one of the 6 Casco Bay islands
named in section 1 may be voted on and elected only by the
residents of the island on which the director resides or owns
property.__The 2 at-large directors who are residents of or
property owners in the State must be elected by the voters of the
6 islands. Each director shall serve serves for a term of 3
years, with 2 directors being elected on a rotating basis each
year. The order of rotation shall must be decided by the
directors by lot at the first meeting of the directors elected.
A majority of the directors shall constitute constitutes a quorum
for the transaction of business, and any action taken by a
majority of directors present at any meeting at which a quorum is
in attendance shall be is deemed to be the action of the full
board of directors.

 
SUMMARY

 
Current law establishes a 12-member board of directors for the
Casco Bay Island Transit District. Eight of the members are
required to be residents or property owners on one of 6 Casco Bay
islands, with Peaks Island having 3 directors and Little Diamond
Island, Great Diamond Island, Long Island, Cliff Island and Great
Chebeague Island having one director each. Two directors are at
large and are required only to be residents of or property owners
in Maine.

 
This bill requires the direct election of each of the
directors by the voters of the island on which the director is
required to reside or own property; only voters of the island
that the director represents may vote for or against that
director. The 2 at-large directors will continue to be elected
by all the voters of the 6 islands. The direct representation
will be phased in over a 3-year period beginning with the
election held in 2006.
