| Be it enacted by the People of the State of Maine as follows: |
|
| | Sec. 1. 22 MRSA §2150-C, sub-§1, as enacted by PL 2001, c. 364, §1, is | amended to read: |
|
| | 1. Definitions. As used in this section chapter, unless the | context otherwise indicates, the following terms have the | following meanings. |
|
| A. "Automated external defibrillator" or "AED" means a | medical device approved by the United States Food and Drug | Administration that: |
|
| (1) Is capable of recognizing the presence or absence | of ventricular fibrillation or rapid ventricular | tachycardia; |
|
| (2) Is capable of determining whether defibrillation | should be performed on an individual; |
|
| (3) Upon determination that defibrillation should be | performed, automatically charges and requests delivery | of an electrical impulse to an individual's heart; and |
|
| (4) Upon action by an operator, delivers an | appropriate electrical impulse to the individual's | heart to perform defibrillation. |
|
| B. "Department" means the Department of Public Safety. |

| | Sec. 2. 22 MRSA §2150-D is enacted to read: |
|
| §2150-D. Facilities for adults |
|
| | 1.__Equipment. A nursing home licensed under section 1811 or a | facility licensed for the care of adults under Subtitle 6, | including a long-term care facility, residential care facility, | assisted housing program or assisted living program, must be | equipped with an automated external defibrillator on each floor | of the facility. |

| | 2.__Training. A staff member for a nursing home licensed under | section 1811 or a facility licensed for the care of adults under | Subtitle 6, including a long-term care facility, residential care | facility, assisted housing program or assisted living program, | must be certified to perform cardiopulmonary resuscitation and | trained to operate an automated external defibrillator. |
