Be it enacted by the People of the State of Maine as follows:

 
Sec. 1. P&SL 1985, c. 57, §23 is repealed and the following enacted in
its place:

 
Sec. 23.__Dissolution.__The district may be dissolved upon the
unanimous vote of the trustees and upon referendum vote being
taken at the next annual municipal election in the Town of York.__
The town clerk of the Town of York shall reduce the subject
matter to the following questions:

 
Question A:__"Shall the York Sewer District be dissolved and
its charter repealed?"

 
Question B:__"Shall the York Sewer District be dissolved and
all of its assets and liabilities be assumed by and become
the responsibility of the Town of York?"

 
Question C:__"Shall the York Sewer District be dissolved and
a new sewer district created under the jurisdiction of the
Public Utilities Commission?"

 
The voters shall vote by ballot on these questions and
designate their choice for only one of the questions and against
2 of the questions by a cross or check mark placed within a
corresponding square below the word "Yes" or "No" their opinion
of the same.__The results must be declared by the municipal
officers and due certificate of the results filed by the town
clerk with the Secretary of State.__If it appears that a
plurality of the legal votes are cast in favor of Question A, the
York Sewer District is dissolved and its charter repealed.__If it
appears that a plurality of the legal votes are cast in favor of
Question B, the York Sewer District is dissolved and all of its
assets and liabilities are assumed by and become the
responsibility of the Town of York.__If it appears that a
plurality of the legal votes are cast in favor of Question C, the
York Sewer District is dissolved and a new district must be
created under the jurisdiction of the Public Utilities
Commission.

 
SUMMARY

 
This bill changes the procedure by which the York Sewer
District may be dissolved.
