| Be it enacted by the People of the State of Maine as follows: |
|
| | Sec. 1. 22 MRSA §2912 is enacted to read: |
|
| §2912.__Donation to research facility |
|
| | 1.__Definition.__For the purposes of this section, "research | facility" means a facility dedicated to the advancement of | medical or dental science or knowledge that receives donations of | all or parts of human bodies for research purposes and that is | not a recipient of donations under section 2903, subsections 1 to | 3. |
|
| | 2.__Requirements.__The acquisition of all or part of a human | body by a research facility is subject to the requirements of | sections 2902 to 2911 and paragraphs A to C. |
|
| A.__The research facility shall provide training in | appropriate procedures for securing donations to all persons | who, on behalf of the research facility, make contact with | the donor or potential donor or members of the donor's | family. |
|
| B.__The research facility shall use standardized forms for | documenting the donation, including, but not limited to: |
|
| (1)__The signed consent of the person executing the | anatomical gift pursuant to section 2902; |
|
| (2)__If only a part is being donated, which part is | being donated and how much of that part; |
|
| (3)__The name of the research facility to which the | part is being donated and the research purpose of the | donation; and |
|
| (4)__Information on how to contact personnel in charge | of donated parts at the research facility regarding the | donation. |
|
| C.__The research facility shall record all telephone | conversations with family members of the donor. |
|
| | This bill establishes procedures for the donation of all or | part of a human body for medical and dental research purposes | when the donation is made to a research facility not already | covered by the provisions of the Uniform Anatomical Gift Act. | The bill subjects donations to a research facility to provisions |
