| 3.__Penalties.__The following penalties apply to violations of | | this section. |

| | | A.__A register who violates subsection 1 commits a Class E | | crime.__Violation of subsection 1 is a strict liability | | crime as defined in Title 17-A, section 34, subsection 4-A. |

| | | B.__A register or employee of the Probate Court who violates | | subsection 2 is subject to a civil penalty of not more than | | $100, to be recovered by a complainant in a civil action for | | the complainant's benefit or by indictment for the benefit | | of the county. |

| | | Sec. K-1. 22 MRSA §47, as amended by PL 1991, c. 797, §6, is | | repealed and the following enacted in its place: |

| | | §47.__Penalties and jurisdiction |
|
| | | 1.__Hinder, obstruct or interfere with agent.__A person who | | hinders, obstructs or interferes with an officer, inspector or | | duly authorized agent of the department while in the performance | | of the officer's, inspector's or agent's duties commits a Class E | | crime. |

| | | 2.__Violation of order, rule or regulation.__A person who | | violates an order, rule or regulation of the department made for | | the protection of life or health under law commits a Class E | | crime unless otherwise provided in this Title. |

| | | 3.__Violation of Title.__Unless another penalty has been | | expressly provided, a person who violates a provision of this | | Title or intentionally or knowingly fails, neglects or refuses to | | perform any of the duties imposed upon that person by this Title | | commits a Class E crime. |
