B.__A person who violates this section after having previously violated this section commits a civil violation for which a fine of not more than $200 may be adjudged.

3.__Additional remedies.__The Maine Potato Commission or a duly authorized representative may recover penalties imposed for violation of this section in a civil action brought in the name of the commission, and if it prevails in such action may recover full costs; or the commission may prosecute for violations of this section by complaint or indictment. The District Court and the Superior Court have concurrent jurisdiction of actions brought for the recovery of penalties imposed by this section and of prosecutions for violations thereof.

Sec. E-2. 10 MRSA §1606 is repealed.

Sec. E-3. 10 MRSA §1661-B, sub-§2, as enacted by PL 1989, c. 83, §2, is repealed and the following enacted in its place:

2.__Penalties.__The following penalties apply to violations of this section.

A.__A person, firm, partnership or corporation who violates this section commits a civil violation for which a fine of not more than $100 may be adjudged.

B.__A person, firm, partnership or corporation who violates this section after having previously violated this section

commits a civil violation for which a fine of not more than $500 may be adjudged.

Sec. E-4. 10 MRSA §1661-B, sub-§3 is enacted to read:

3.__Enforcement.__The Commissioner of Agriculture, Food and Rural Resources shall enforce this section pursuant to Title 7, section 14.
