B.__A__person at least 18 years of age approved by that
hunter's parent or guardian who either holds a valid Maine
hunting license or has successfully completed a hunter safety
course acceptable under sections 10108 and 11105.

 
4. Hunters 16 years of age; penalties.__The following
penalties apply to violations of subsection 3.

 
A.__A person who violates subsection 3 commits a civil
violation for which a fine of not less than $100 nor more
than $500 may be adjudged.

 
B. A person who violates subsection 3 after having been
adjudicated as having committed 3 or more civil violations
under this Part within the previous 5-year period commits a
Class E crime.

 
5.__Expiration of junior hunting license.__A junior hunting
license issued to a person who has passed that person's 15th
birthday is valid through the calendar year for which the license
is issued.__All other permit requirements for a person who is 16
years of age or older apply to a person who continues to hunt
with a junior hunting license.

 
6. Definition.__For the purposes of this section, "in the
presence of" means in visual and voice contact without the use of
visual or audio enhancement devices, including binoculars and
citizen band radios.

 
Sec. 117. 12 MRSA §11109, sub-§3, śN, as enacted by PL 2003, c. 414,
Pt. A, §2 and affected by Pt. D, §7, is amended to read:

 
N. A license to use leashed dogs to track wounded deer
animals, which permits a person to use one or more leashed
dogs to track a lawfully wounded deer, moose or bear, is
$25.

 
Sec. 118. 12 MRSA §§11110 and 11111 are enacted to read:

 
§11110.__Transfer of hunting areas or zones

 
A person who has been assigned a designated hunting area or
zone by the department for purposes of hunting a game animal may
exchange that designated zone or area with another person
assigned a different hunting zone or area for the same game
animal for purposes of hunting that same game animal. The
commissioner may adopt rules to implement this section.__Rules
adopted pursuant to this section are routine technical rules as
defined in Title 5, chapter 375, subchapter 2-A.
