2.__Penalty.__A person who violates subsection 1 commits a
civil violation for which a forfeiture of not less than $100 nor
more than $500 may be adjudged.

 
3.__Removal of abandoned ice fishing shacks.__Notwithstanding
the provisions of Title 33, chapter 41, a landowner on whose
property an ice fishing shack is left in violation of Title 17,
section 2264 may remove or destroy the shack.__The landowner may
recover any costs of removing or destroying the shack from the
owner of the shack in a civil action.

 
§12662.__Night ice fishing

 
1.__Prohibition.__Except as provided in section 12659,
subsection 2, a person may not ice fish from 1/2 hour after
sunset to 1/2 hour before sunrise of the following morning.

 
2.__Penalty.__A person who violates this section commits a
civil violation for which a forfeiture of not less than $100 nor
more than $500 may be adjudged.

 
§12663. Unlawful sale of lead sinkers

 
1.__Prohibition.__A person may not:

 
A.__Sell a lead sinker for fishing that contains any lead
and weighs 1/2 ounce or less; or

 
B.__Offer for sale a lead sinker for fishing that contains
any lead and weighs 1/2 ounce or less.

 
For the purposes of this subsection, "sinker" means a device that
is designed to be attached to a fishing line and intended to sink
the line.__"Sinker" does not include artificial lures, weighted
line, weighted flies or jig heads.

 
2.__Civil penalty.__A person who violates this section commits
a civil violation for which a forfeiture of not less than $100
nor more than $500 may be adjudged.
