A person who violates this section commits a Class E crime.

 
§11216.__Hunting with aid of aircraft

 
1.__Prohibition on use of aircraft to hunt.__A person on the
ground or airborne may not use an aircraft to aid or assist in
hunting:

 
A.__Bear;

 
B.__Deer; or

 
C.__Moose.

 
2.__Penalties.__The following penalties apply to this section.

 
A.__A person who violates subsection 1 without the taking of
a bear, deer or moose commits a civil violation for which a
forfeiture of not less than $100 nor more than $500 may be
adjudged, unless otherwise specified.

 
B.__A person who violates subsection 1 and takes a bear,
deer or moose commits a Class E crime for which the court
shall impose a fine of not less than $500, none of which may
be suspended.

 
§11217.__Buying and selling wild animals and wild birds

 
1.__Prohibition against buying and selling bear, deer, moose
or wild turkey.__Except as provided in subsection 2, a person may
not:

 
A.__Buy, sell or offer for sale or barter a:

 
(1)__Bear;

 
(2)__Deer;

 
(3)__Moose; or

 
(4)__Wild turkey;

 
B.__Aid in buying, selling or offering for sale or bartering
a:

 
(1)__Bear;

 
(2)__Deer;
