| discharge a firearm within 100 yards of a residential | dwelling without the permission of the owner or, in the | owner's absence, of an adult occupant of that dwelling; or |

| B.__Possess a wild animal or wild bird taken in violation of | this subsection, except as otherwise provided in this Part. |
|
| This subsection may not be construed to prohibit a person from | killing or taking a wild animal in accordance with sections 12401 | and 12402. |
|
| A person who violates this subsection commits a Class E crime. |

| §11210.__Shooting domestic animals |
|
| | Except as provided in section 12404, subsection 6, paragraph | C, a person may not, while on a hunting trip or in the pursuit of | wild animals or wild birds, intentionally, knowingly, recklessly | or negligently shoot and wound or kill any domestic animal, | including, but not limited to, a dog, cat or domestic bird.__A | person who violates this section commits a Class E crime. |

| | A person may not use any firearm other than a shotgun in the | Town of Southport or the islands within the confines of the Town | of Southport.__A person who violates this section commits a civil | violation for which a forfeiture of not more than $100 nor less | than $500 may be adjudged, unless otherwise specified. |

| §11212.__Motor vehicles and motorboats |
|
| | 1.__Prohibition.__The following provisions apply to shooting | from a motor vehicle or motorboat or possessing a loaded firearm | in a motor vehicle. |
|
| A.__A person may not shoot while in or on a motor vehicle or | motorboat or while in or on a trailer or other type of | vehicle being hauled by a motor vehicle except: |
|
| (1)__A person may hunt migratory waterfowl from a motorboat | in accordance with federal regulations; |
|
| (2)__Paraplegics and single or double amputees of the legs | may shoot from motor vehicles that are not in motion; | and |
|
| (3)__A person may shoot from a motorboat when the motor | is shut off and the boat is drifting, beached, moored, |
