B.__A person who violates this subsection after having
previously violated this subsection commits a civil
violation for which a fine of not more than $200 may be
adjudged.

 
Sec. E-11. 10 MRSA §2702 is repealed and the following enacted in
its place:

 
§2702. Penalty for failure to pay

 
1.__Payment for services rendered.__A person, firm or
corporation for whom scales, weights and measures or any weighing
or measuring devices have been tested by a local sealer of
weights and measures may not neglect or refuse to pay for the
services rendered.

 
2.__Penalties.__The following penalties apply to violations of
this section.

 
A.__A person, firm or corporation who violates subsection 1
commits a civil violation for which a fine of $3 plus costs
must be adjudged.

 
B.__A person, firm or corporation who violates subsection 1
after having previously violated subsection 1 commits a
civil violation for which a fine of not less than $10 plus
costs and not more than $20 plus costs must be adjudged.

 
Sec. E-12. 10 MRSA §8003-C, sub-§3, as enacted by PL 1999, c. 687, Pt.
C, §12, is repealed and the following enacted in its place:

 
3. Unlicensed practice; criminal penalties. Notwithstanding
any other provision of law:

 
A.__A person who practices or represents to the public that
the person is authorized to practice a profession or trade
and intentionally, knowingly or recklessly fails to obtain a
license as required by this Title or intentionally,
knowingly or recklessly practices or represents to the
public that the person is authorized to practice after the
license required by this Title has expired or been suspended
or revoked commits a Class E crime; and

 
B.__A person who practices or represents to the public that the
person is authorized to practice a profession or trade and
intentionally, knowingly or recklessly fails to obtain a license
as required by this Title or intentionally, knowingly or
recklessly practices or represents to the public that the person
is authorized to practice after the
