Sec. C-2. 8 MRSA §222, as amended by PL 1999, c. 671, §3, is repealed
and the following enacted in its place:

 
§222.__Possession of fireworks

 
1.__Possession prohibited.__A person may not possess or have
under that person's control fireworks.

 
2.__Value does not exceed $100.__If the value of the fireworks
does not exceed $100, a person who violates subsection 1 commits
a civil violation for which a fine of not more than $50 may be
adjudged.

 
3.__Value exceeds $100.__If the value of the fireworks exceeds
$100, a person who violates subsection 1 commits a Class E crime.

 
4.__Exception.__This section does not apply to a person issued
a permit pursuant to section 227-A.

 
Sec. C-3. 8 MRSA §223, as enacted by PL 1985, c. 23, §2, is amended
to read:

 
§223. Sale of fireworks

 
1. Sale of fireworks prohibited. No A person may not sell,
possess with the intent to sell or offer for sale fireworks.

 
2. Value exceeds $5,000. It is a Class B crime to sell,
possess with the intent to sell or offer for sale fireworks the
value of which If the value of the fireworks exceeds $5,000, a
person who violates subsection 1 commits a Class B crime.

 
3. Value exceeds $1,000. It is a Class C crime to sell,
possess with the intent to sell or offer for sale fireworks the
value of which If the value of the fireworks exceeds $1,000 but
does not exceed $5,000, a person who violates subsection 1
commits a Class C crime.

 
4. Value does not exceed $1,000. It is a Class D crime to
sell, possess with the intent to sell or offer for sale
fireworks the value of which If the value of the fireworks does
not exceed $1,000, a person who violates subsection 1 commits a
Class D crime.

 
5. Value. "Value" is determined in accordance with Title 17-
A, section 352, subsection 5.
