| Sec. C-2. 8 MRSA §222, as amended by PL 1999, c. 671, §3, is repealed | | and the following enacted in its place: |

| | | §222.__Possession of fireworks |
|
| | | 1.__Possession prohibited.__A person may not possess or have | | under that person's control fireworks. |
|
| | | 2.__Value does not exceed $100.__If the value of the fireworks | | does not exceed $100, a person who violates subsection 1 commits | | a civil violation for which a fine of not more than $50 may be | | adjudged. |
|
| | | 3.__Value exceeds $100.__If the value of the fireworks exceeds | | $100, a person who violates subsection 1 commits a Class E crime. |
|
| | | 4.__Exception.__This section does not apply to a person issued | | a permit pursuant to section 227-A. |
|
| | | Sec. C-3. 8 MRSA §223, as enacted by PL 1985, c. 23, §2, is amended | | to read: |
|
| | | 1. Sale of fireworks prohibited. No | | possess with the intent to sell or offer for sale fireworks. |
|
| | | 2. Value exceeds $5,000. It is a Class B crime to sell, | possess with the intent to sell or offer for sale fireworks the | value of which | | person who violates subsection 1 commits a Class B crime. |
|
| | | 3. Value exceeds $1,000. It is a Class C crime to sell, | possess with the intent to sell or offer for sale fireworks the | value of which | | does not exceed $5,000, a person who violates subsection 1 | | commits a Class C crime. |
|
| | | 4. Value does not exceed $1,000. It is a Class D crime to | sell, possess with the intent to sell or offer for sale | fireworks the value of which | | not exceed $1,000, a person who violates subsection 1 commits a | | Class D crime. |
|
| | | 5. Value. "Value" is determined in accordance with Title 17- | A, section 352, subsection 5. |
