complaint in the District Court in accordance with Title 4,
chapter 5.

 
5.__Grounds for discipline.__Grounds for an action to modify,
suspend, revoke or refuse to renew the license of a person
licensed under this chapter are:

 
A.__The practice of fraud or deceit in obtaining a license
under this chapter or in connection with service rendered
within the scope of the license issued;

 
B.__A violation of this chapter or a rule adopted by the
commissioner; and

 
C.__Conviction of a crime involving cruelty to animals.

 
6.__Violation; penalty.__A person may not knowingly violate
this chapter or the rules issued pursuant to this chapter.__The
following penalties apply.

 
A.__A person who violates this subsection commits a civil
violation for which a fine of not more than $100 may be
adjudged.

 
B.__A person who violates this subsection after having
previously violated this subsection commits a civil
violation for which a fine of not more than $250 may be
adjudged.

 
7.__Rules.__ The commissioner may adopt rules that are
necessary to carry out the purposes of this chapter.

 
8.__Inspection.__In connection with the granting, continuance
or renewal of a license and in connection with an investigation
of alleged cruelty or alleged violation of this chapter or the
rules issued pursuant to this chapter, the commissioner, at least
annually, may visit and inspect the research and teaching
institutions or animal research and care facilities of any
licensee or of any research or teaching institution that has
applied for a license.

 
Sec. B-24. 7 MRSA §4204, sub-§1, as amended by PL 1999, c. 723, §1, is
further amended to read:

 
1. Nutrient management plan required. A person who owns or
operates a farm that meets the criteria established in subsection
2 shall have a nutrient management plan for that farm and shall
implement the provisions in that plan by the dates specified for
that category of farm in subsection 4, 5, 6 or 7. The nutrient
management plan must be prepared by a person certified in
