| 5.__Investigation of nongaming employees.__The state law |
enforcement agency may investigate misconduct of employees of |
the tribal gaming operator or any other entity who are not |
gaming employees but who are employed in ancillary facilities |
located within the same building as any gaming facility; and |
such employees must be dismissed from such employment upon |
notification by the state law enforcement agency that their |
conduct in the course of their employment in such ancillary |
facilitates poses a threat to the effective regulation of gaming |
or creates or enhances the dangers of unfair or illegal |
practices, methods and activities in the conduct of gaming, |
subject to the same rights of appeal as are provided in the |
Maine Administrative Procedure Act. |
