| Sec. 1. Bureau of Insurance to amend rules. Resolved: That by January 1, |
| 2004, the Department of Professional and Financial Regulation, |
| Bureau of Insurance shall amend Rule Chapter 275, Medicare |
| Supplement Insurance, to provide under Section 12 of the rule, |
| Guaranteed Issue for Eligible Persons, that an individual who |
| had prior coverage under a Medicare supplement policy and who |
| loses eligibility under the MaineCare program is entitled to |
| the same Medicare supplement policy in which the beneficiary |
| was previously enrolled, if available from the same insurer, |
| without regard to the period of time between the termination |
| of the prior Medicare supplement policy and the reenrollment |
| of that beneficiary after the loss of eligibility for the |
| MaineCare program. The rules must also require that adequate |
| notice of the guaranteed issue provision be provided to a |
| Medicare beneficiary at the time the beneficiary enrolls in |
| the MaineCare program. Rules adopted pursuant to this section |
| are routine technical rules as defined in the Maine Revised |
| Statutes, Title 5, chapter 375, subchapter 2-A. |
