Be it enacted by the People of the State of Maine as follows:

 
Sec. 1. 38 MRSA §590-F is enacted to read:

 
§590-F.__Protection against hazardous indoor air quality

 
A resource recovery facility burning municipal solid waste
shall provide safety glasses, a hard hat and a dust mask or
single-use respirator to every person 18 years of age or
younger who enters that facility for the purposes of a tour of
the facility.__The respirator must be of a type approved by
the National Institute of Occupational Safety and Health, or a
successor organization, to protect the user against inhalation
of any particulates, dust or mists that may be encountered
within that facility.__The facility shall provide the safety
glasses, hard hat and dust mask or respirator at no cost and
shall instruct the user on the proper use of the respirator.

 
SUMMARY

 
This bill requires resource recovery facilities that burn
municipal solid waste to provide safety glasses, a hard hat
and a dust mask or single-use respirator to every person 18
years of age or younger who tours that facility. The
respirator must be of a type approved by National Institute of
Occupational Safety and Health to protect the user against any
particulates, dust or mists that may be encountered within
that facility. The facility shall provide the safety glasses,
hard hat and dust mask or respirator at no cost and shall
instruct the user on the proper use of the respirator.
