Sec. 1. 24 MRSA §2907 is enacted to read:

§2907.__Expert testimony

A person, health care entity or health care provider may not impede a physician, podiatrist, dentist or any other health care provider from voluntarily providing expert testimony on behalf of a claimant, as long as the claim in question does not involve that person, health care entity or health care provider.

For purposes of this section, "impede" includes, but is not limited to, actions adversely affecting employment, access to a facility, credentialing and other penalties or rewards.

SUMMARY

This bill amends the Maine Health Security Act to prohibit a person, health care entity or health care provider from impeding the expert testimony of another health care provider unless the testimony concerns a claim involving the person, health care entity or health care provider.
