F.__Take an adverse action against a consumer based on
credit information unless an insurer obtains and uses a
credit report issued or an insurance score calculated
within 90 days before the date the policy is first written
or renewal is issued.

 
3.__Notice of use of consumer reports.__If consumer reports
are used by an insurer, an insurer shall provide written
notice to consumers at the time of application for coverage
that the insurer uses consumer reports in making underwriting
decisions.__The notice must include contact information to
allow an applicant to address questions to the insurer
relating to credit-based underwriting decisions by the
insurer.

 
4.__Notice of adverse underwriting decisions.__If an insurer
makes an adverse underwriting decision using information
obtained from a consumer report in compliance with this
section, the insurer shall provide the applicant or
policyholder with written notice of the adverse underwriting
decision.__The notice must also include the following
information:

 
A.__The specific reason for the adverse underwriting
decision;

 
B.__The specific credit-based information used to support
the underwriting decision;

 
C.__Contact information, including name, address and
telephone number, for a person employed by the insurer who
can answer questions concerning credit-based underwriting
decisions made by the insurer;

 
D.__Contact information, including name, address and
telephone number, for the consumer reporting agency that
provided the insurer with the credit-based information;
and

 
E.__Statements informing an applicant or policyholder of a
consumer's right to obtain a copy of that consumer's
consumer report and the right to challenge information
contained in that consumer report.

 
5.__Applicability.__This section applies only to personal
automobile insurance and property and casualty insurance.__
This section does not apply to commercial insurance.
