Sec. 1. 12 MRSA §7001, sub-§36-A, as enacted by PL 1989,c. 913, Pt. B, §1, is amended to read:

36-A. Trap, the noun. "Trap" means any device that is designed primarily to catch or hold wild animals, including, but not limited to, a foothold trap, a killer-type trap, or a cage-type trap or a snare. "Trap" does not mean a snare.

Sec. 2. 12 MRSA §7035, sub-§3, ¶B, as amended by PL 1999, c. 636, §1, is repealed.

Sec. 3. 12 MRSA §7432, sub-§11, ¶A, as amended by PL 2001, c. 307, §7, is further amended to read:

A. Sets or tends a snare for the purpose of trapping any wild animal or wild bird, except as provided in section 7035, subsection 3 and section 7453-B;

Sec. 4. 12 MRSA §7453-B, as enacted by PL 1993, c. 438, §30, is repealed.

SUMMARY

This bill prohibits the use of snares to capture any wild bird or animal.
