Sec. 1. Rulemaking. Resolved: That, by November 1, 2003 the
Department of Human Services shall amend the rules governing
the operation of the Maine Registry of Certified Nursing
Assistants, referred to in this section as "the registry," to
implement the requirements of this section. By November 1,
2003 the Department of Administrative and Financial Services
shall amend the rules governing the operation of the
Information Resource of Maine, referred to in this section as
"InforME," to implement the requirements of this section. By
November 1, 2003 the Department of Public Safety shall amend
the rules governing access to criminal history record
information to implement the requirements of this section.
Rules adopted pursuant to this section are routine technical
rules as defined in Title 5, chapter 375, subchapter 2-A.

 
1. The registry must be made a part of InforME and
businesses and individuals must have access to information in
the registry at the cost of $3 per inquiry.

 
2. The registry must be allowed access to criminal history
record information at the Department of Public Safety without
charge.

 
3. An entity that is sponsoring a training course for
certified nursing assistants must pay for the initial criminal
history record check for individuals who complete the course,
with funding for the cost of the criminal history record check
coming from the course fee.

 
4. The rules for the registry must provide for revocation
of certification of a certified nursing assistant who is
convicted of a Class A, Class B or Class C crime.

 
SUMMARY

 
This resolve requires rulemaking to improve the operation of
the Maine Registry of Certified Nursing Assistants and to
improve access to information in the registry.
