| Be it enacted by the People of the State of Maine as follows: |

| | Sec. 1. 28-A MRSA §1402-A, sub-§§1 and 4, as enacted by PL 1997, c. | 228, §1, are amended to read: |
|
| | 1. Invoice required. The products must be accompanied by | an invoice.__For partial-bottle wine samples provided to | retail licensees for licensed on-premises consumption, an | invoice must be issued to the agent of the wholesale licensee.__ | The agent shall maintain a log stating the name of the | licensees who sampled the product and the amount sampled; |

| | 4. Maximum annual sample established. The maximum amount of | samples given to a retail licensee may not exceed 3 gallons of | beer and 3 gallons of wine annually of any malt beverage and 3 | liters of any wine; |
|
| | This bill amends current law to allow a partial bottle of | wine as a sample. The bill also requires the wholesale | licensee to document the amount of product sampled along with | other details of the sampling. Additionally, this bill brings | state law into compliance with federal law concerning the | amount of beer and wine samples that may be given to a retail | licensee on an annual basis. |
