§15303.__Licensing; requirements

1.__License required.__A person may not claim to be a legal document technician or practice as a legal document technician unless the person is licensed in accordance with this chapter.

2.__Requirements.__An applicant for a license under this chapter shall submit a written application with supporting documents to the department on a form provided by the department.__ To be considered by the department as qualified for a license under this chapter, the applicant must:

A.__Be 18 years of age or older;

B.__Possess a high school diploma or its equivalent and any other educational requirement or experience requirement that the commissioner determines necessary;

C.__If the commissioner determines that an examination is necessary, pass an examination that the commissioner may develop with the assistance of the advisory council to demonstrate competency in the profession;

D.__Certify to the department that the applicant:

(1) Has not been convicted of a felony in any jurisdiction, a misdemeanor involving theft, misrepresentation or dishonesty in any jurisdiction or a violation of Title 4, section 807 or a comparable violation in another jurisdiction;

(2)__Has not been held liable in a civil action for fraud, misrepresentation or the use of an unfair, unlawful or deceptive business practice;

(3)__Has not been held liable in a civil action for negligent, reckless or willful failure to perform the duties as a legal document technician;

(4)__Has not had the applicant's license as a legal document technician revoked; or
