JOINT RESOLUTION RECOGNIZING MAY 2023 AS LYME DISEASE AWARENESS MONTH
WHEREAS,the Maine Center for Disease Control and Prevention reported over 2,600 probable cases of Lyme disease in 2022;and
WHEREAS, the actual incidence of Lyme disease in Maine is likely much higher than reported;and
WHEREAS, Lyme disease disproportionately affects children between 5 and 15 years ofage and adults over 65 years of age; and
WHEREAS, tickborne illness can be prevented by staying in the center of wooded paths, wearing light-colored, long-sleeved clothing, using an insect repellent approved by the United States Environmental Protection Agency, performing daily tick checks and properly removing ticks;and
WHEREAS, the 124th Legislature enacted Public Law Chapter 494, An Act To Enhance Public Awareness of Lyme Disease, which designated May as Lyme Disease Awareness Monthand required the promotion of public awareness and education on Lyme disease and other tickborne illnesses;and
WHEREAS, public awareness and education are necessary to help reduce tickborne illnesses in Maine by promoting awareness of Lyme disease and other tickborne illnesses and the regular use of prevention measures, as illustrated by the 2023 information campaign “Tick Free ME” produced by the Maine Center for Disease Control and Prevention; now,therefore, be it
RESOLVED: That We, the Members of the One Hundred and Thirty-first Legislature now assembled in the First Special Session, on behalf of the people we represent, take this opportunity to recognize May 2023 as Lyme Disease Awareness Month and to respectfullyurge all the citizens of Maine to become aware of the steps that can be taken to reduce the risk of tickborne illnesses.

PROCEDURAL ORDER
On May 16, 2023, the Maine State Legislature referred five questions to the Justices of the Supreme Judicial Court, pursuant to Article VI Section 3 of the Maine Constitution, related to four direct initiatives of voters that the Secretary of State transmitted to the 131st Legislature during its First Regular Session but that the Legislature did not act on during that session.
The Justices hereby invite a representative for each of the Maine Legislature, Governor Mills, the Secretary of State, and the Attorney General, and any other interested person or entity, to submit briefs addressing
1. whether the Questions propounded present a “solemn occasion,”pursuant to article VI, section 3 of the Maine Constitution;and
2. the law regarding the Questions propounded.
Any person or entity submitting a brief to the Court must do so by filing two copies of the brief, as described below, with the Executive Clerk of the Supreme Judicial Court, at 205 Newbury Street, Room 139, Portland, Maine 04101, at or before 4:00 p.m. on May 26, 2023, and emailing an electronic copy (which need not be signed) in the form of a single text-based pdf file to lawcourt.clerk@courts.maine.gov.
A person's brief need not be bound but must conform to the requirements of M.R. App. P. 7A(g) (as amended by 2022 Me. Rules 03, effective July 13, 2022) and must comply with the following: a. the front cover must be white and must contain the following information: · the designation that the matter is “Before the Justices of the Supreme Judicial Court”; · the docket number of the matter, OJ-23-1; · the title of the matter, “In the Matter of Request for Opinion of the Justices”; · the title of the document as a “Brief of” followed by the name of the person or entity filing the brief; and · the name, address, and Maine bar number of counsel representing the filer or, if the filer is not represented by counsel, the name and address of the filer; and b. the brief may not be longer than 25 pages.

WHEREAS, more than 6,000,000 pets end up homeless every year in the United States; and
WHEREAS, there are 143 animal shelters and animal rescue organizations in the State, whose organizers and employees work tirelessly to rehome and care for homeless, abandoned, abused and rescued animals; and
WHEREAS, animal shelters and animal rescue organizations cannot operate without the help of volunteers who provide support for homeless pets through donations of time, goods and funds;and
WHEREAS, animal shelters and animal rescue organizations work with law enforcement agencies, veterinarians and other community organizations to find a home for every pet,encourage responsible pet ownership, educate the public on the proper care and well-being of animals, devote personal time and resources in helping to rescue animals, reunite families with lost pets and help to protect the welfare of helpless animals; now,therefore, be it

In Memory of: (5-36) Marjorie Hoffman, of South Berwick. Mrs. Hoffman was born in Brooklyn, New York and spent much of her life in Orange County, New York, where she began working in the insurance business in 1958. She was active as a Girl Scout Troop leader and became president of the local Girl Scout Council. She joined the Insurance Women of Orange County and eventually became president of the organization. When she retired, she moved to South Berwick, where she volunteered at the food pantry, the Bible Speaks Church and Wentworth Douglass Hospital for 29 years, working in the gift shop and as a patient advocate. She was a communicant of Our Lady of the Angels Church in South Berwick. Mrs. Hoffman will be long remembered and sadly missed by her family and friends;

(5-37) Adrienne Doyle, of Gardiner. Ms. Doyle, among other occupations in her working life, served as Lead Purchasing Agent for the Maine Army National Guard. A voracious reader, she hosted a book group at her home in Gardiner for many years. Ms. Doyle will be long remembered and sadly missed by her family and friends and all those whose lives she touched;

Mr. Jacques was a teacher at Biddeford High School, where he taught math for over 30 years, became department head and established the first school computer lab in the area. He also spent over 30 summers working beside his brother at the Clam Shack in Kennebunkport, where their customers were all friends and the "crew" was another opportunity to work closely with his wife, children, nieces, nephews and friends. Upon retiring from teaching and the Clam Shack, he was proud of his retirement job in sales at Vic's appliance in Saco. Mr. Jacques will be long remembered and sadly missed by his family and friends and all those whose lives he touched;

For decades, every Valentine's Day, he placed hundreds of red paper hearts on storefronts and notable landmarks and huge banners in unexpected places in Portland.
