JOINT RESOLUTION URGING THE CONGRESS OF THE UNITED STATES TO REPEAL AND REPLACE OUTDATED AUTHORIZATIONS OF MILITARY FORCE

 

           WE, your Memorialists, the Members of the One Hundred and Thirtieth Legislature of the State of Maine now assembled in the First Special Session, most respectfully present and petition the Congress of the United States, as follows:

 

           WHEREAS, nearly 2 decades after the attack on the World Trade Center and the Pentagon, United States troops continue to wage war in Iraq, Afghanistan and other parts of the world; and

 

           WHEREAS, our service members accomplished their original objectives in Afghanistan long ago, at great psychological, physical and spiritual cost; and

 

           WHEREAS, the war on terrorism, the “forever war” or “endless war” as many call it, has been used as the basis for an ever-expanding range of military actions; and

 

           WHEREAS, James Madison wrote to Thomas Jefferson in 1798, “The constitution supposes, what the History of all Governments demonstrates that the Executive is the branch of power most interested in war . . . . It has accordingly with studied care, vested the question of war in the Legislature”; and

 

           WHEREAS, Congress has mostly abdicated its Article I responsibilities to authorize andoversee military actions by extensive, potentially permanent delegations of congressional war powers;and

 

           WHEREAS, the Authorization for Use of Military Force passed after the September 11 attacks has now been in effect for more than twice as long as the 1964-1971 Gulf of Tonkin Resolution, which gave President Lyndon B. Johnson authorization, without a formaldeclaration of war by Congress, for the use of conventional military force in Southeast Asia; and

 

           WHEREAS, the United States Department of Defense’s 2018 National Defense Strategyoutlines a scenario where great power competition, rather than counterterrorism, drives the department’s decision making and use of force; and

 

           WHEREAS, a growing number of foreign policy officials have begun to advocate for a drawdown in the Middle East and Central Asia because of the opportunity costs to America’s mission of balancing its strength against the so-called revisionist powers of China and Russia; and

 

           WHEREAS, the emphasis on bolstering a deterrent posture in Asia and Europe shouldhave an attendant impact that reduces the United States military’s activities in the Middle East, Africa and the Western Hemisphere; and

 

           WHEREAS, from global pandemics to the support of weak and fragile states, the United States faces an unprecedented number of complex global threats that cannot be solved by military power alone;and

 

           WHEREAS, a disproportionate amount of resources is going to military and intelligencesolutions along with a more general sidelining of diplomacy amid a continuing militarization of foreign policy;and

 

           WHEREAS, addressing the root causes of violent conflicts overseas through developmentand diplomacy helps protect Americans and helps reduce the need to send our service members into harm’s way;now, therefore, be it

 

           RESOLVED: That We, your Memorialists, respectfully urge and request that the Congressof the United States work to renew a proper constitutional balance in American foreign policy decision making by repealing and replacing outdated authorizations for the use of military force; andbe it further

 

           RESOLVED: That We, your Memorialists, advocate for the importance of a civilian-ledapproach to elevating development and diplomacy along with a strong defense in order to build a better, safer world;and be it further

 

           RESOLVED: That suitable copies of this resolution, duly authenticated by the Secretary of State, be transmitted to the Honorable Joseph R. Biden, Jr., President of the United States; the President of the United States Senate; the Speaker of the House of Representatives of the United States; and each Member of the Maine Congressional Delegation.

JOINT RESOLUTION TO REAFFIRM THE FRIENDSHIP BETWEEN MAINE AND TAIWAN AND SUPPORT BILATERAL TRADE RELATIONS AND TAIWAN’S INTERNATIONAL PARTICIPATION

 

           WHEREAS,the United States and the Republic of China (Taiwan) share a vibrant bilateral relationship marked by a mutually beneficial partnership, supported by our common values of freedom, democracy, rule of law and a free market economy, and our countries now enjoy the strongest relations ever; and

 

           WHEREAS, President Tsai Ing-wen has worked tirelessly to ensure the prosperity of Taiwan’s 23.5 million people and promote international standing and has expressed commitment to peace and stability in the Indo-Pacific region; and

 

           WHEREAS, the United States Department of State, Department of Commerce and Department of Agriculture clarified United States policy regarding Taiwan in a formal letter sent to governors of all 50 states dated November 21, 2019 stating that “expanding relations with Taiwan in areas such as trade, education, investment, and tourism is fully compatible with and supports U.S. policy and can be beneficial to your state or municipality”;and

 

           WHEREAS, President Tsai has expressed Taiwan’s desire to reach a bilateral tradeagreement with the United States, and the 116th United States Congress’s Public Law 116-135, “Taiwan Allies International Protection and Enhancement Initiative (TAIPEI) Act of 2019,” affirms that the United States should engage in strengthening bilateral trade and economic relations with Taiwan;and

 

           WHEREAS, New England exported more than $1 billion in goods to Taiwan in 2020, of which Maine exported $52 million in goods, mostly in computer and electronic products, fish and other marine products, machinery and chemicals, making Taiwan Maine’s 12th largest export market in the world and the 7th largest export market in Asia in 2019, and Taiwan and the United States seek to increase trade and investment through a bilateral trade agreement, resulting in even greater Maine exports to Taiwan, educational and cultural exchange, scientific and technological interests and tourism; and

 

           WHEREAS, Taiwan is a key transport hub in the Asia-Pacific region, making its inclusionin international organizations such as the World Health Organization, the International Criminal Police Organization and the International Civil Aviation Organization imperative for the best interests and safety of the international community.  In addition, Taiwan’s inclusion in the United Nations Framework Convention on Climate Change is important to the global effort to combat climate change; now, therefore, be it

 

           RESOLVED: That We, the Members of the One Hundred and Thirtieth Legislature now assembled in the First Special Session, on behalf of the people we represent, reaffirm the friendship between Maine and the Republic of China (Taiwan), and we continue to supportefforts to further strengthen United States-Taiwan and Maine-Taiwan trade and investment relations and support Taiwan’s participation in international organizations and agreements, including the World Health Organization, the International Criminal Police Organization, the International Civil Aviation Organization and the United Nations Framework Convention on Climate Change, and encourage the further exploration of ways to strengthen and promote bilateral exchange between Maine and Taiwan, including the possibility of signing a driver’s license reciprocity agreement with Taiwan, which would lead to a further increase in trade and people-to-people exchanges; and be it further

 

           RESOLVED: That suitable copies of this resolution, duly authenticated by the Secretary of State, be transmitted to the Honorable Joseph R. I am pleased to submit this report in accordance with the Petroleum Market Share Act ("PMSA"), 10 M.R.S. § 1677. The PMSA requires the Attorney General to make a report to the Legislature describing the concentration of retail outlets in the State, including a recommendation as to whether additional legislation is needed to further limit or curtail the activity of refiners operating retail outlets.

 

Enclosed is a report describing concentration of retail outlets in the State. The report, which is based on data collected from wholesalers of both motor fuel oil and home heating oil, includes maps depicting relative concentration in designated markets throughout the State. This report is also available on the Attorney General's website at: https://www.maine.gov/ag/docs/Bi­annual%20PMSA%20Report%202019-20.pdf

 

Since no refiners of petroleum products operate retail outlets in this State, we recommend no legislation to limit or curtail such operations.

           (5-80)  Alexis Johnson Madore, of Presque Isle.  Mrs. Madore worked for over 40 years as an office manager for Aroostook Shoe, Agway Truck Broker and Main Way Transportation.  An avid golfer, she was a 21-time Ladies Club Champion at Presque Isle Country Club, as well as a champion of many other golf and bowling tournaments in Maine and New Brunswick.  Mrs. Madore will be long remembered and sadly missed by her husband of 51 years, Barry, her family and her friends and all those whose lives she touched;

           (5-81)  Richard Lewis, of Lewiston, a gifted drummer and musician known by many as "Rycky Styx."  Mr. Lewis was a self-taught drummer who played in bands throughout southern Maine, including the popular 1980s hair metal band Twyce Shy and No Guts No Glory.  He also played for various other bands, including Impact, First Strike and Foxfire.  He worked at Goodwin's Volvo in Topsham for over 30 years, eventually becoming the parts manager, and most recently was an estimator at Moody's Collision Centers in Portland.  He was a Fourth Degree member of the Knights of Columbus Sekenger Council No. 1947, was a member for over 30 years and served as a Deputy Grand Knight and Grand Knight.  He was also an active member of the Patriot Riders Motorcycle Club.  Mr. Lewis will be long remembered and sadly missed by his family and friends and all those whose lives he touched;

           (5-82)  Roy Alan Rodgers, of Belfast.  Mr. Rodgers founded Birdseye Builders, first partnering with Warren Greeley, and later with Mr. Greeley's son, Dan Greeley, and built, restored or remodeled over 60 homes in Belfast and the surrounding area.  He served his community as a youth mentor for the Restorative Justice Project and served on the In-town Design Review Committee for the city.  For 20 years, he was an invaluable member of ComeBoating!, was one of that group's two longest-serving coxswains and participated in domestic and international rowing competitions, including races in England and Bermuda.  Mr. Rodgers will be long remembered and sadly missed by his family and friends and all those whose lives he touched;

           (5-83)  Dorothy Quimby, of Unity.  Mrs. Quimby served as Unity College's first Librarian from 1965 to her retirement in 2001 as Professor Emeritus.  Her proudest moment in her career was when the library at Unity College was named the "Dorothy Webb Quimby Library" in her honor.  She was a faculty adviser to hundreds of Unity students over her career and became known affectionately as the "Mother of the Alumni."  She edited the college's alumni newsletter for many years as her way to keep in touch with "her kids," and she always enjoyed handing out seedling trees to graduates.  She was very active in community affairs.  Over the years, she served as town treasurer, on the town budget committee, as chair of the Unity Scholarship Committee, as an active member of the Unity Historical Society, as a member of Unity United Church, where she sang in the choir for many years and was part of the women's group, and on the Board of Future RSU 3.  Mrs. Quimby will be long remembered and sadly missed by her family and friends and all those whose lives she touched;

           (5-84)  John W. Sullivan, of Acton.  Mr. Sullivan was a beloved math teacher and coach at Noble High School in North Berwick for 57 years, retiring in 2003 but shortly thereafter returning part-time.  As well as coaching basketball and baseball teams at the school, he refereed basketball games for many years, and the school recognized his contributions by naming its baseball field in his honor.  Mr. Sullivan will be long remembered and sadly missed by his wife of 52 years, Terry, his family and friends and all those whose lives he touched;

           (5-85)  Adam MacDonald, of Presque Isle.  Mr. MacDonald represented the Muscular Dystrophy Association as a State Poster Child both in South Carolina and in Maine and as an adult continued representing the association as a Goodwill Ambassador.  While representing the association, he attended many events and helped organize events of his own to help raise funds for research. For 25 years, he volunteered on Labor Day weekends for local broadcasts of the Jerry Lewis MDA Telethon.  In his later years, he hosted a popular annual Christmas party and was followed on Facebook by his friends, who looked forward to his Themed Trees, among his other pursuits.  Mr. MacDonald will be long remembered and sadly missed by his family and friends and all those whose lives he touched;

           (5-86)  Michael Hinds, of Sanford, a 24-year veteran of Alfred Fire and Rescue.  Mr. Hinds, a veteran of the National Guard with many years of service, joined Alfred Fire and Rescue in 1997 as a firefighter and served on its call force.  He was a mentor to young firefighters and was well-known within the local fire and EMS community, especially for his passion for fire sevice, but also for his kindness, good humor and hard work.  He volunteered at Sanford Regional Technical School teaching in the fire science program and also served on the board of directors for the York County Firefighters Association.  Mr. Hinds will be long remembered and sadly missed by his family and friends and all those whose lives he touched;

           (5-87)  Robert Dorr, of Ellsworth, Deputy Chief of the Ellsworth Fire Department.  Deputy Chief Dorr joined the department in 2009.  He was hired by the department as a career firefighter in 2010 and quickly rose through the ranks to become Deputy Chief in January of this year.  He also served as Lead Instructor for the Hancock County Fire Academy for many years.  Deputy Chief Dorr will be long remembered and sadly missed by his family and friends and all those whose lives he touched;

           (5-88)  Richard A. Petrie, of Tampa, Florida and formerly of Portland.  Mr. Petrie joined the United States Air Force in 1955 and trained as a medical corpsman.  He served in Vietnam in 1967 and 1968 as crew on a C-141 Starlifter evacuating wounded and injured troops.  He remained in the medical field for half of his military career, then changed his occupation to Special Agent with the Air Force Office of Special Investigations.  He retired from the military in 1976, having served for almost 21 years.  In 1979, he started at the Maine Department of Human Services, working as an investigator, and later worked as a detective in the Medicaid Fraud Control Unit within the Criminal Division of the Office of the Maine Attorney General.  He retired from state service in 1997.  Mr. Petrie will be long remembered and sadly missed by his wife of 37 years, Rosalynne, his family and friends and all those whose lives he touched;

RE:                 Reprimand of Hon. John Andrews

Please be advised that the House Ethics Committee convened on Wednesday, June 2, 2021 in Legislative Council Chambers at 11:15 a.m. to discuss the matter of a breach of House Rules. During our deliberations Rep. Andrews admitted to the breach of rules and has volunteered to remove himself from today’s House deliberations.

 

House rules are in place to ensure order and decorum of the chamber. These rules are necessary to protect the rights of all members to represent their districts. Violations of these rules compromises the House’s ability to function as a governing body. The committee appreciates that Rep. Andrews admitted his violation and sought a reasonable solution. Please be advised that continued breaches of rules will be met with more severe penalties.

 

Should Representative Andrews comply with the established rules of order and decorum, he will be admitted back into the chamber.
