Requires local school administrative units to: 1) create an online portal to act as the single source for all student information and data that can be accessed by 3rd-party contractors; 2) adopt policies and procedures to ensure the approved curriculum presented is implemeted in the classroom without change; 3) post at least 3 years of data regarding certain student enrollment and performance; 4) make audio and video recordings of professional development and instructional programs offered to schools and make the recordings accessible to the public free of charge for at least 3 years after the event date; and 5) maintain a list showing the date of attendance of each professional development and instructional program, name and position of attendee, program name and description for the prior 3 years and make the list free of charge to residents of the State. The required local activities in this bill may represent a state mandate pursuant to the Constitution of Maine. If the bill does require a local unit of government to expand or modify its activities so as to necessitate additional expenditures from local revenue, the state mandate provisions of the Constitution of Maine require either: (1) General Fund appropriations be provided to fund at least 90% of any additional necessitated local costs of the mandate; or (2) a Mandate Preamble be added to the bill and two-thirds of the members of each House vote to exempt the mandate from the funding requirement. If the bill does represent a state mandate and neither one of these actions occurs, the local units of government will not be required to implement the mandated activities.
Fiscal Detail and Notes
The Office of Innovation within the Department of Education will require ongoing General Fund appropriation of $575,524 in fiscal year 2023-24 and $117,191 in fiscal year 2024-25 for the costs associated with making certain data and information available on its publicly accessible website.  Of that amount, General Fund appropriations of $75,624 in fiscal year 2023-24 and $107,191 in fiscal year 2024-25 will be required for one Management Analyst II position and related All Other costs to update and maintain data and information related to all administrator, teacher and staff professional development and instructional programs offered to schools that are paid for with state funds.  Additionally, General Fund appropriations of $500,000 in fiscal year 2023-24 and $10,000 per year beginning in fiscal year 2024-25 will be required to develop and maintain a system to house the data.
