An Act To Allow Certain Retired Law Enforcement Officers and Trained Law Enforcement Officers To Serve as School Security Officers

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 20-A MRSA §6556  is enacted to read:

§ 6556 Qualification of school security officer

A school administrative unit as defined in section 1, subsection 26 may employ as a school security officer a person who:

1 Compliance with criminal history record information requirements.   Has complied with the requirements of section 6103; and
2 Law enforcement officer qualifications.   Meets the qualifications for a law enforcement officer either:
A As set forth in Title 25, chapter 341; or
B By virtue of previously having met the qualifications for and served as a certified law enforcement officer for a state, county, municipal or federal law enforcement agency and having retired from that position in good standing.

Sec. 2. 25 MRSA §2801-B, sub-§1, ¶K,  as corrected by RR 2005, c. 1, §9, is amended to read:

K. A contract officer appointed by the Commissioner of Public Safety pursuant to Title 28-A, section 82-A; or

Sec. 3. 25 MRSA §2801-B, sub-§1, ¶L,  as reallocated by RR 2005, c. 1, §10, is amended to read:

L. A transport officer . ; or

Sec. 4. 25 MRSA §2801-B, sub-§1, ¶M  is enacted to read:

M A person employed as a school security officer by a school administrative unit pursuant to Title 20-A, section 6556 who served as a certified law enforcement officer for a state, county, municipal or federal law enforcement agency and who retired from that position in good standing.

This bill allows a school administrative unit to employ as a school security officer a person who is a trained law enforcement officer or a person who meets the qualifications for a law enforcement officer as set forth in the Maine Revised Statutes, Title 25, chapter 341 or a person who has retired in good standing from a position as a certified law enforcement officer for a state, county, municipal or federal law enforcement agency and who meets the requirements for criminal history record information of Title 20-A, section 6103.
