An Act To Amend the Laws Governing Dual Liquor Licenses

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 28-A MRSA §1208, sub-§2, ¶B,  as reallocated by PL 2009, c. 510, §7, is repealed.

Sec. 2. 28-A MRSA §1208, sub-§2, ¶C,  as reallocated by PL 2009, c. 510, §7, is amended to read:

C. Wine may be served only to be consumed on the premises when accompanied by a full meal if a full meal is available for purchase and consumption on the premises. For the purposes of this paragraph, "full meal" means a diversified selection of food that cannot ordinarily be consumed without the use of tableware and cannot be conveniently consumed while standing or walking;

Sec. 3. 28-A MRSA §1208, sub-§2, ¶E,  as reallocated by PL 2009, c. 510, §7, is amended to read:

E. A licensee may not serve wine to be consumed on the premises after 8:00 10:00 p.m.

This bill makes changes to the laws governing dual liquor licenses. It allows a licensee to serve wine until 10 p.m., rather than until 8 p.m. It removes the restriction that wine may be served to be consumed on the premises only when accompanied by a full meal and instead requires only that a full meal be available for purchase and consumption. It removes the requirement that a licensee have 2 employees at least 21 years of age present at all times in order to serve wine for on-premises consumption and sell wine for off-premises consumption.
