Amend the bill by striking out all of the emergency preamble (page 1, lines 1 to 9 in L.D.).

Amend the bill by striking out all of section 1 and inserting the following:

‘Sec. 1. 12 MRSA §6575-M is enacted to read:

§ 6575-M. Aquaculture quota; eligible harvesters

The following provisions govern elver quota allocated specifically for use in aquaculture.

1. Annual list of license holders. A person who receives an elver quota to be allocated specifically for use in aquaculture shall submit to the commissioner annually a list of the elver license holders who provided that person with their elver quota.

2. Eligibility. An elver license holder chosen to provide a person with any portion of the elver quota allocated specifically for use in aquaculture is not eligible again for a period of 3 years to provide elvers to a person who receives an elver quota to be used specifically in aquaculture.

3. Prior violations. A person who has an elver fishing violation under section 6505-A or chapter 621, subchapter 2, article 5 in the previous 6 years is not eligible to provide elvers to a person who receives an elver quota to be allocated specifically for use in aquaculture.’

Amend the bill by striking out all of the emergency clause.

Amend the bill by relettering or renumbering any nonconsecutive Part letter or section number to read consecutively.

This amendment replaces the bill. It specifies that a person receiving an elver quota to be allocated specifically for use in aquaculture shall provide to the Commissioner of Marine Resources a list of elver license holders who provided that person with their elver quota. Once an elver license holder is chosen, that license holder is not eligible to provide elvers to a person allocated an elver quota to be used in aquaculture for a period of 3 years. A person who has any elver fishing violations in the previous 6 years is not eligible to provide elvers to a person who receives an elver quota to be used in aquaculture.
