An Act To Allow the Adoption of Ordinances Prohibiting the Accumulation of Trash on Private Property in Plantations and Unorganized Territories

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 30-A MRSA §7051, sub-§11,  as amended by PL 2017, c. 3, §1, is further amended to read:

11. Ordinances.  Chapter 141, but only with respect to junkyards and automobile graveyards, subject to chapter 183, subchapter 1, animal control ordinances, subject to Title 7, section 3950, and the sale and use of consumer fireworks within the plantation, subject to Title 8, section 223-A.

Sec. 2. 30-A MRSA §7501-A  is enacted to read:

§ 7501-A Regulation of junkyards and automobile graveyards authorized

The county commissioners of a county may enact an ordinance for the purpose of regulating junkyards and automobile graveyards in the same manner as a municipality may pursuant to chapter 183, subchapter 1.

SUMMARY

This bill grants to plantations the power to control junkyards and automobile graveyards in the same manner as municipalities may control junkyards and automobile graveyards. The bill also grants to county commissioners the power to control junkyards and automobile graveyards in unorganized territories in the same manner as municipalities may control junkyards and automobile graveyards.
