An Act To Improve School Safety

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 17-A MRSA §210, sub-§3 is enacted to read:

3. In addition to the penalties under chapters 51 and 53, for a person who violates subsection 1, paragraph B, if the building or place of assembly is a public elementary or secondary school, the following penalties apply and may not be suspended:

A. If the person has a driver's license under Title 29-A, section 1251, a court-ordered suspension of the license for one year;

B. If the person is eligible for but does not have a driver's license under Title 29-A, section 1251, a court-ordered delay of issuance of the license for one year from the date of conviction of the violation; or

C. If the person is not eligible for a driver's license under Title 29-A, section 1251, a court-ordered delay of issuance of the license for one year from the date that the person is eligible to obtain a license.

A public middle or secondary school shall display a notice of the provisions of this subsection in one or more conspicuous locations in the school.

This bill provides for a mandatory one-year suspension of a driver's license for a person convicted of terrorizing if the terrorizing causes the evacuation of a public elementary or secondary school. If the person does not have a driver's license, the bill specifies a one-year delay in the issuance of the driver's license from the date of the conviction of the offense or, if the person is not eligible for a driver's license, a one-year delay from the date that the person is eligible for the license. This bill also requires that a notice of the provisions of the law be conspicuously posted in at least one location in every public middle and secondary school.
