Amend the bill in section 1 in §3174-ZZ in subsection 2 in the 4th and 5th lines (page 1, lines 16 and 17 in L.D.) by striking out the following: " to a Medicaid recipient or to a Medicare recipient"

Amend the bill in section 1 in §3174-ZZ in subsection 2 in the last line (page 1, line 19 in L.D.) by inserting after the following: " board" the following: ' to a Medicaid recipient who is diagnosed with an intellectual disability or autism spectrum disorder'

Amend the bill by striking out all of section 2 and inserting the following:

Sec. 2. Medicaid state plan amendment and waiver. The Department of Health and Human Services shall prepare and submit a state plan amendment and waiver as required to the United States Department of Health and Human Services, Centers for Medicare and Medicaid Services by January 1, 2018 that provides or requests, as appropriate, Medicaid coverage for music therapy services to Medicaid recipients who have a diagnosis of an intellectual disability or autism spectrum disorder, including, but not limited to, persons who receive home and community-based support benefits under the MaineCare program pursuant to a waiver granted under the federal Social Security Act, Section 1915(c).’

This amendment, which is the minority report of the committee, narrows the Medicaid population that is eligible for music therapy under the MaineCare program to adults and children with a diagnosis of an intellectual disability or autism spectrum disorder. It also clarifies that the bill does not apply to Medicare recipients. It also moves the date by which the Department of Health and Human Services must prepare and submit a state plan amendment and waiver as required to the United States Department of Health and Human Services, Centers for Medicare and Medicaid Services to January 1, 2018.
