Amend the bill by inserting after the enacting clause and before section 1 the following:

Sec. 1. 12 MRSA §13152, sub-§1,  as enacted by PL 2003, c. 414, Pt. A, §2 and affected by c. 614, §9, is amended to read:

1. License.   An operator's license is not required for the operation of an ATV, except as required by section 13157-A, subsection 6, paragraph H and Title 29-A.’

Amend the bill by inserting after section 1 the following:

Sec. 2. 29-A MRSA §2080,  as amended by PL 2005, c. 577, §32, is repealed and the following enacted in its place:

§ 2080 Operation of all-terrain and off-road vehicles

1 All-terrain vehicles and off-road vehicles subject to motor vehicle requirements.   Notwithstanding any other provision of law, except as provided in subsection 2, whenever an all-terrain vehicle or off-road vehicle is operated on a way, the vehicle and operator are subject to the provisions of this Title.
2 Exceptions.   Notwithstanding subsection 1, whenever an all-terrain vehicle or off-road vehicle is operated on a way, the vehicle and operator are not subject to:
A Chapters 5, 7, 13 and 15; and
B Chapter 11, except as provided in Title 12, section 13157-A, subsection 6, paragraph H.

Amend the bill by relettering or renumbering any nonconsecutive Part letter or section number to read consecutively.

SUMMARY

This amendment is the minority report of the committee. The amendment clarifies provisions of law to reflect that a driver's license is required to operate an all-terrain vehicle or off-road vehicle on a way designated as an ATV-access route as provided in the bill.
