An Act To Require That Candidates for the Office of County Sheriff Who Meet the Basic Corrections Training Standards Have Corrections Supervisory Experience

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 30-A MRSA §371-B, sub-§3, ¶E,  as enacted by PL 2011, c. 342, §34, is amended to read:

E. The candidate swears to or affirms that the candidate has at least 5 years of supervisory employment experience and submits the name, address and telephone number for the relevant employer or employers , except that, for a candidate who submits written certification under paragraph D, subparagraph (2), the supervisory experience under this paragraph must be in the field of corrections.

Sec. 2. 30-A MRSA §371-B, sub-§4,  as amended by PL 2003, c. 510, Pt. C, §11, is further amended to read:

4. Exception.   Any person who is serving in the office of sheriff on June 26, 1997 January 1, 2018 or who served prior to that date is deemed to meet the minimum qualifications of subsection 3.

Sec. 3. Effective date. This Act takes effect January 1, 2018.

SUMMARY

Current law requires a candidate for county sheriff to submit written certification from the Maine Criminal Justice Academy that the person has met the basic law enforcement training standards under the Maine Revised Statutes, Title 25, section 2804-C or the basic corrections training standards under Title 25, section 2804-D. This bill requires that a person who submits written certification that the person has met the basic corrections training standards must also swear to or affirm that the person has at least 5 years of supervisory employment experience in the field of corrections. A person serving in the office of sheriff on January 1, 2018 or who served prior to that date is exempt from this requirement. The bill includes an effective date of January 1, 2018.
