Establishes a mandatory minimum sentence of 25 years for the conviction of a defendant who manufacturers and traffics in methamphetamine.
Fewer cases settled without trial court costs.
Fiscal Detail and Notes
Establishing a mandatory minimum sentence of 25 years for the conviction of a defendant who manufactures and traffics methamphetamine will result in additional costs to the state correctional system.  The additional costs depend on prior sentences established by our judicial system which currently range from 0 to 10 years compared to the new mandatory minimum of 25 years.  This proposed change could impact the state correctional system as early as fiscal year 2007-08.  It is projected that approximately 5 offenders could be sentenced in fiscal year 2007-08 and as many as 10 in fiscal year 2008-09.  This legislation will also result in current costs for additional time requirements for judges, clerks, law clerks, security, court reporters and indigent defense.  Since felony charges are given priority within the Judicial Branch, this legislation may delay other types of cases in the judicial system.
