Amend the bill in section 1 in subsection 1 by striking out all of paragraph B (page 1, lines 8 to 13 in L.D.) and inserting the following:

B A public school that serves breakfast shall provide all students who are eligible for free and reduced-price meals under paragraph A a meal that meets the requirements of the federal School Breakfast Program set forth in 7 Code of Federal Regulations, Part 220(2007) at no cost to the student. The State shall provide funding equal to the difference between the federal reimbursement for a free breakfast and the federal reimbursement for a reduced-price breakfast for each student eligible for a reduced-price breakfast and receiving breakfast.

Amend the bill by striking out all of sections 2, 4, 5, 6, 7, 8 and 9 and inserting the following:

Sec. 4. 22 MRSA §1511, sub-§6, ¶H,  as enacted by PL 1999, c. 401, Pt. V, §1, is amended to read:

H.  Comprehensive school health and nutrition programs, including school-based health centers.

Sec. 5. Appropriations and allocations. The following appropriations and allocations are made.

Fund for a Healthy Maine - School Breakfast Program N035

Initiative: Allocates funds from the Fund for a Healthy Maine to reimburse those public schools kindergarten to grade 12 who provide breakfast for the amount equal to the difference between the federal reimbursement for a free breakfast and the federal reimbursement for a reduced-price breakfast for each student eligible for a reduced-price breakfast who is receiving breakfast.

Fund for a Healthy Maine - School Breakfast Program N035

Initiative: Allocates one-time funds from the Fund for a Healthy Maine for system modifications to allow the Department of Education to reimburse those public schools that are providing breakfast for the cost of providing free breakfasts to eligible students.

Amend the bill by relettering or renumbering any nonconsecutive Part letter or section number to read consecutively.

SUMMARY

This amendment clarifies that the State pay the cost of breakfast now paid by students eligible for a reduced-price breakfast for those schools that choose to provide breakfast. It also replaces the appropriations and allocations section to reflect the intent of the bill.
