An Act To Include the Town of Nobleboro within the Service Area of the Great Salt Bay Sanitary District

Be it enacted by the People of the State of Maine as follows:

Sec. 1. P&SL 1991, c. 85, §1  is amended to read:

Sec. 1. Great Salt Bay Sanitary District; additional purposes; expanded powers. The Great Salt Bay Sanitary District, formed under the Maine Revised Statutes, Title 38, chapter 11 and referred to in this Act as “the district,” is granted additional powers, rights, privileges and obligations as provided in this Act for the purpose of allowing the district to supply the towns and inhabitants and others within the territory of the district with potable water for domestic, sanitary, commercial, industrial, agricultural and municipal purposes and to supply water and wastewater services to the Town of Nobleboro. All authority and powers of the Great Salt Bay Sanitary District as previously granted continue in full force and effect. The board of trustees of the district as presently elected and constituted may exercise all additional powers, rights, privileges and obligations granted by this section in the same manner as currently empowered for the affairs of this district.

Sec. 2. Referendum; effective date. This Act takes effect only for the purpose of permitting its submission to the legal voters of the Town of Nobleboro at an election called for that purpose and held within 2 years of the effective date of this Act. The election must be called, advertised and conducted according to the law relating to municipal elections, except that the registrar of voters is not required to prepare or the clerk to post a new list of voters. For the purpose of registration of voters, the registrar of voters must be in session the secular day preceding the election. The subject matter of this Act is reduced to the following question:

“Do you favor allowing the Great Salt Bay Sanitary District to supply the Town of Nobleboro with water and wastewater services?”

The results must be declared by the municipal officers of the Town of Nobleboro and the certificate of the results filed by the clerk with the Secretary of State.

This Act takes effect for all other purposes immediately upon its acceptance by a majority of the legal voters of the Town of Nobleboro. Failure to achieve the necessary approval by a majority of voters at an election does not prohibit subsequent referenda held within 2 years of the effective date of this Act.

This bill amends the charter of the Great Salt Bay Sanitary District by allowing the district to supply wastewater services to the Town of Nobleboro. The bill also requires that the legal voters of the Town of Nobleboro approve letting the Great Salt Bay Sanitary District supply them with water and wastewater services at a referendum before it can take effect.
