Amend the amendment in Part E in section 1 in §6006-G in subsection 2 in paragraph B in the 2nd line (page 9, line 20 in amendment) by inserting after the following: " 159;" the following: ' and'

Amend the amendment in Part E in section 1 in §6006-G in subsection 2 by striking out all of paragraph C (page 9, lines 21 and 22 in amendment)

Amend the amendment in Part E in section 1 in §6006-G in subsection 2 by relettering the lettered paragraphs to read consecutively.

Amend the amendment in Part F by striking out all of section 2 (page 10, lines 35 to 38 and page 11, lines 1 to 22 in amendment) and inserting the following:

Sec. F-2. 25 MRSA §1509-A  is enacted to read:

§ 1509-A State Police funding

Beginning July 1, 2009, state funding for the Department of Public Safety, Bureau of State Police must be provided in accordance with this section.

1 General Fund.   The percentage of state funding for the Department of Public Safety, Bureau of State Police appropriated from the General Fund must be according to the following schedule.

Amend the amendment in Part G in section 2 in subsection 2 in the first line (page 12, line 5 in amendment) by striking out the following: " $25" and inserting the following: ' $20'

Amend the amendment in Part G in section 9 in subsection 1 in the first line (page 14, line 1 in amendment) by striking out the following: " $30" and inserting the following: ' $26'

Amend the amendment in Part H in section 1 by striking out all of subsection 7 (page 14, lines 21 to 29 in amendment) and inserting the following:

7 Sales tax revenue.   Beginning July 1, 2009, and every July 1st thereafter, the State Controller shall transfer to the STAR Transportation Fund an amount, as certified by the State Tax Assessor, that is equivalent to the revenue from the 10% tax imposed on the value of rental for a period of less than one year of an automobile pursuant to Title 36, section 1811. The tax amount must be based on actual sales for that fiscal year and may not consider any accruals that may be required by law. The amount transferred from General Fund sales and use tax revenues does not affect the calculation for the transfer to the Local Government Fund under Title 30-A, section 5681, subsection 5.

Amend the amendment by striking out all of Part I (page 14, lines 30 to 34 and page 15, lines 1 to 15 in amendment)

Amend the amendment on page 15 by striking out all of lines 16 to 33 and on page 16 by striking out all of lines 1 to 18 and inserting the following:

summary

This amendment makes the following changes to Committee Amendment "A."

1. It removes language that establishes the percentage of state funding for the Department of Public Safety, Bureau of State Police that must be appropriated and allocated from the General Fund and the Highway Fund, respectively, after fiscal year 2011.

2. It reduces the increase in the annual service fee for a vanity registration plate and reduces the increase in certain fees that must be paid to the Secretary of State.

3. It specifies that the State Controller shall make the required transfer to the STAR Transportation Fund rather than the Treasurer of State and clarifies other aspects of this transfer.

4. It removes language that requires increasing percentages of transportation-related sales tax receipts to be transferred from the General Fund to transportation-related funds.
