Resolve, Directing the Department of Professional and Financial Regulation To Study the Necessity and Feasibility of Regulating Certain Mechanical Trades

Sec. 1. Study. Resolved: That the Department of Professional and Financial Regulation, referred to in this resolve as "the department," shall conduct a study to determine the necessity and feasibility of regulating the following mechanical trades:

1. Heating systems installation;

2. Ventilation systems installation;

3. Air conditioning systems installation;

4. Refrigeration systems installation;

5. Pipefitting;

6. Gas fitting;

7. Steam fitting; and

8. Medical gas distribution.

In conducting the study, the department shall review the public safety issues associated with the trades specified in this section, the necessity of regulating the trades specified in this section and the feasibility of streamlining existing regulatory programs to encompass oversight of the trades that are the subject of this study; and be it further

Sec. 2. Report. Resolved: That the department shall submit the results of the study under section 1, together with any necessary implementing legislation, to the Joint Standing Committee on Business, Research and Economic Development no later than February 1, 2008. Following receipt and review of the report, the Joint Standing Committee on Business, Research and Economic Development may submit a bill to the Second Regular Session of the 123rd Legislature.

This resolve directs the Department of Professional and Financial Regulation to conduct a study of the necessity and feasibility of regulating certain mechanical trades within existing regulatory programs of the department. The resolve allows for the appropriate legislative oversight committee to submit proposed legislation in the Second Regular Session of the 123rd Legislature.
